Automated decisions at the border need human review

I volunteer with a legal aid clinic that helps newcomers navigate visa and benefits processes. I have seen cases where automated systems flagged an application as high risk and the applicant never received a coherent explanation of why. In at least two cases this year, after we pushed, the flag was reversed. But most people in that situation do not have a volunteer lawyer at their side. They accept the outcome and move on with their lives shaped by a decision no human ever meaningfully reviewed. I have been reading about Canada's Directive on Automated Decision-Making and I think the instinct behind it is correct: the higher the impact on a person's life, the higher the level of human oversight and transparency required. The gap is enforcement. A directive is only as good as the teams asked to implement it. My ask, as someone who sees the human end of these systems, is that the agencies using them publish clear algorithmic impact assessments, provide real avenues for appeal, and ensure that a person facing a negative automated decision gets, in plain language, what factors drove that decision and how to respond. AI in government can be done well. The tools are not the issue. The question is whether the people affected by them have any real standing to push back.
